Is Kratom Legal in My State? – Legality Map

The ongoing debate around Kratom legality in the United States has continued for almost five years now. Although there was an attempt by the DEA to classify Kratom as a Schedule I substance on a Federal level, a significant pushback from the community, both through Congress, as well as through the White House, thwarted their efforts.

The DEA has since passed the matter over to the FDA, which is known to be tremendously prejudiced against herbal supplements. Unfortunately, several local authorities also took matters into their own hands and have already outlawed the plant in several states and/or cities without much debate on the matter.

To keep tabs on the legal status of Kratom across U.S. territory, we’ve prepared a Kratom legality map that is meant to help both beginners and experienced users who must travel on a regular basis. The chart is regularly updated whenever there is news and/or progress regarding Kratom legal efforts.

Whenever you have to ask yourself “Is Kratom legal?”, you can consult this map and get the information you need on a national level. 

 

Alabama

Back in 2016, the Alabama Senate decided to classify mitragynine and 7-hydroxymitragynine as artificial, illegal substances, which is objectively ridiculous. Unfortunately, since the plant contains both of these naturally-occurring alkaloids, it means that Kratom is illegal in Alabama.

Arizona

In Arizona, there was danger of Kratom becoming illegal in 2014. However, the Kratom Consumer Protection Act of 2019 guarantees Kratom is now legal in this state.

Arkansas

Kratom is illegal in Arkansas since 2015. The local senate classified it as a Schedule I drug, falsely claiming that both the plant and its two most potent alkaloids are opium derivatives. 

California

Kratom is legal in California with the exception of San Diego, where it is illegal to sell, possess, manufacture or distribute. 

Colorado

With the exception of Denver, Kratom is legal in Colorado state. Within Denver, however, people are not allowed to either sell or serve Kratom since 2017.

Florida

Despite several specific county initiatives to ban Kratom, the plant remains legal in Florida. Sarasota is the only county in Florida where Kratom is illegal.

Georgia

Kratom is currently legal in Georgia, where the House passed the GA: H783 legislation.

Illinois

In 2014, Illinois passed an amended legislature allowing Kratom to be sold to anyone who is 18 years or older. This is not the case with Jerseyville and Alton, where Kratom is still illegal.

Indiana

Due to a legislation passed in 2014, Kratom is illegal throughout the state of Indiana.

Kansas

There was danger of Kratom being outlawed back in 2018, but the plant was removed from KS: SB282 and, as such, it continues to be legal in Kansas.

Kentucky

In 2016, the Kentucky government had wanted to ban Kratom, but the bill eventually failed. As such, Kratom continues to be legal in Kentucky.

Louisiana

A bill to study the effects of Kratom was passed in 2019 and a bill to ban it is currently under debate. For now, Kratom is legal in Louisiana, but this may change within a year’s time. 

Maine

A 2017 bill attempted to classify Kratom as hallucinogenic, but the substance was eventually removed from the text. Thus, Kratom is now legal in Maine.

Maryland

Marylanders are worry-free when it comes to Kratom. The plant is legal in this state.

Michigan

In 2017, a bill to classify Kratom under Schedule V failed. As of 2019, another similar attempt is currently under way. So far, Kratom is legal in Michigan, but a doctor’s prescription will be required to buy this plant if case the new bill will pass.

Minnesota

Kratom is completely legal in Minnesota.

Missouri

Although St. Charles’ county is considering a future ban, Kratom is currently legal throughout Missouri.

Nevada

In 2016, Nevada enacted the KPCA and became the 4th state to legally regulate Kratom. Although the plant is prohibited for people under the age of 18, Kratom is legal in Nevada.

New Mexico

This state is free of any legal repercussion against Kratom, so Kratom is legal in New Mexico.

New York

There was a severe push to ban Kratom in 2017, which could have banned the plant throughout the entire state. Fortunately, the attempt failed and Kratom continues to be legal in NY.

New Jersey

As of 2018, Kratom is legal throughout New Jersey without any restrictions whatsoever.

North Carolina

In 2015, a bill to ban Kratom was defeated due to a significant community-wide response. At present, Kratom is legal in North Carolina for people over the age of 18.

Ohio

The state of Ohio is considering a bill to regulate Kratom, much like Nevada. Currently, Kratom is legal in Ohio.

Oklahoma

The local community has successfully thwarted efforts to ban Kratom in 2014. As of right now, Kratom is legal in Oklahoma.

Oregon

For now, Kratom is legal and unregulated in the state of Oregon.

Pennsylvania

At present, some media outlets are trying to raise safety concerns about Kratom, but with no official response or position. For now, Kratom remains legal in Pennsylvania.

South Carolina

No official efforts against Kratom have been recorded in this state. Consequently, Kratom is legal in South Carolina.

Tennessee

Natural, 100% pure Kratom is legal in Tennessee for individuals over the age of 21.

Texas

Much like in South Carolina and Minnesota, Kratom is absolutely legal in Texas.

Utah

Kratom is legal in Utah and can be purchased by anyone over 18 years of age. The local KCPA mandates that the product be accurately labelled.

Virginia

No legislation to ban or regulate Kratom in Virginia was ever attempted so far. Thus, Kratom is legal in this state.

Washington State

Kratom is completely legal in Washington State.

Wisconsin

Unfortunately, the Wisconsin Senate criminalized the two primary alkaloids present in Kratom back in 2014. Currently, Kratom is illegal in Wisconsin.

Canada

In Canada, it is illegal to sell Kratom for human consumption, but not to possess or consume it yourself. 

 

What Can You Do About Kratom Legality?

This is what the Kratom legality map looks like right now. As soon as there are any updates regarding Kratom across the United States, they will be included in our chart. 

Even if the plant is banned in several areas, this doesn’t mean the public should just accept the status quo. If you happen to live in a place where Kratom is illegal or where local governments are planning to ban it, talk to your representative personally and tell them why this is unnecessary and potentially harmful. It is your right as a citizen.
